1. Who we are
This website, cherrypickerhire.me, is operated by Cherry Picker Hire Ltd, a company registered in England and Wales under company number 14669423, whose registered office is at 33 Sycamore Grove, Trowbridge, Wiltshire, BA14 0JB.
References to “we”, “us” and “our” on this page mean Cherry Picker Hire Ltd. You can contact us on 07473 841141 or at info@cherrypickerhire.me.
2. Accepting these terms
By using this website you accept these terms of use. If you do not accept them, please do not use the site.
These terms govern your use of the website only. They are not the terms on which we hire out access platforms — see section 5.
3. Information on this website
The content of this website is provided for general information about our services. We take care to keep it accurate and up to date, but we do not warrant that it is complete, current or free from error.
Machine specifications, working heights and reach figures shown on this site or in the downloadable PDF datasheets are the manufacturer’s published figures. Actual performance on any given site depends on ground conditions, obstructions, wind speed and how the machine is set up.
Nothing on this website is professional advice about your particular job. Whether a machine is suitable for your work at height is a decision we make together after we understand the site, and it is confirmed in the quotation we give you.
4. Rates and availability
The rates shown on this website are guide prices in pounds sterling for the machine and hire period stated, and are intended to help you budget. They are not an offer capable of acceptance.
A binding price is the one set out in the written quotation we send you for your specific job. That quotation takes account of the site, the distance from our depot, the access, the duration and any additional requirements.
We are not registered for VAT, so no VAT is added to our rates or invoices. The figure you are quoted is the figure you pay.
Rates, availability and the machines in our fleet may change without notice. Showing a machine on this site does not mean it is available on any particular date.
5. Hiring from us
Submitting the enquiry form, calling us or emailing us does not create a hire contract and does not reserve a machine. It is a request for a quotation.
A hire contract is formed only when we confirm a booking in writing. Every hire is subject to our terms of hire, which we supply with the quotation and which cover matters such as payment, cancellation, site conditions, insurance and liability. Please read them before you accept a quotation.
If there is any conflict between these website terms and our terms of hire, the terms of hire apply to the hire.
6. Intellectual property
All content on this website — text, photographs, the layout and the design — is owned by us or used with permission, and is protected by copyright and other intellectual property rights.
You may view the site, and print or download extracts, for your own information or to evaluate our services. You may not reproduce, republish, redistribute or commercially exploit any part of it without our written permission.
The photographs of our machines and completed jobs are our own work. Please do not use them on other websites, in adverts or in listings.
The IPAF and CSCS logos shown on this site are the trade marks of their respective owners and appear solely to indicate the certifications our operators hold.
7. Acceptable use
You must not use this website:
- in any way that breaks any applicable law or regulation;
- to send us false, misleading or abusive enquiries, or enquiries on someone else’s behalf without their knowledge;
- to submit the enquiry form by automated means, or to send unsolicited advertising through it;
- to knowingly transmit any material that contains a virus or other harmful code;
- to copy, scrape or harvest the site or any part of it by automated means; or
- to attempt to gain unauthorised access to the site, the server it is hosted on, or any connected system.
We may withdraw access to the site, and report the matter to the relevant authorities, if you breach this section.
8. Links to other websites
This site links to third-party pages, including our Google Business Profile, Facebook page and YouTube channel. Those links are provided for your convenience. We have no control over the content of those sites and accept no responsibility for them or for any loss arising from your use of them.
You may link to our home page provided you do so fairly and lawfully, and in a way that does not suggest any association or endorsement that does not exist.
9. Our liability for this website
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. Your statutory rights as a consumer are not affected.
Subject to that, we do not accept liability for any loss or damage arising from your use of, or reliance on, this website or its content — including loss of profit, loss of business, business interruption or loss of anticipated savings. This section is about the website; our liability under a hire contract is dealt with in our terms of hire.
10. Availability of the website
We do not guarantee that this website will always be available or uninterrupted. Access may be suspended, withdrawn or restricted at any time, for example for maintenance or for reasons outside our control. We will not be liable if the site is unavailable at any time or for any period.
11. Changes to these terms
We may revise these terms at any time by updating this page. The version in force is the one published here when you use the site, so please check back from time to time. The date at the top of this page shows when it was last changed.
12. Governing law
These terms, and any dispute arising out of or in connection with them or your use of this website, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the United Kingdom you may also bring proceedings in the courts of the part of the UK in which you live.
